Gold Industry Group WANL Season Pass

The below terms and conditions relate to the 2025 Gold Industry Group West Australian Netball League terms and conditions for Season Passes.

Terms & Conditions

Season Pass offered by NETBALL WA (INC) ABN 36 657 982 648 (“Netball WA”).     

Season Pass holders acknowledge and agree that their Gold Industry Group Season Pass is subject to these Terms and Conditions. 

1. DEFINITION  

In these Terms & Conditions:  

“Home Match” means any of the matches designated as a Netball WA home match during the Gold Industry Group West Australian Netball League home and away season and excludes any Finals Matches.  

“Finals Match” means any match designated as a Netball WA home finals match played at a venue.  

“LEAGUE” MEANS THE GOLD INDUSTRY GROUP WEST AUSTRALIAN NETBALL LEAGUE (GIG WANL) COMPETITION CONDUCTED BY NETBALL WA (INC), ABN 36 657 982 648.  

“Matches” means Home Matches and Finals Matches (as appropriate).  

“Venue” means the Gold Netball Centre, or any other stadium where a GIG WANL Home Match is played.    

2. PURCHASE  

2.1 Season Pass Purchase 

Season Passes may be purchased at the Gold Netball Centre where venue staff are present.  

2.2 Confirmation and Acceptance   
Once you purchased your Season Pass, Netball WA will send you an email confirming your Season Pass. A valid email address is required at the point of sale in order to receive confirmation. 

2.3 Season Pass Card  
A Season Pass card shall be issued upon purchase, with a unique Season Pass number. 

Season Passes exclude access to GIG WANL Finals games.  

Netball WA may introduce a digital season pass in the future to replace a printed card.  

2.4 Refund   
Once a completed Season Pass is purchased and card received, the purchase is considered final, and refunds and exchanges are only permitted as expressed in the “Refund Policy” of these Terms & Conditions.   

2.5 Right to refuse   
Netball WA reserves the right to refuse a Season Pass to any person at its absolute discretion.  

3. SEASON PASS FEES  

3.1 Annual Fee 
Where applicable, Netball WA will set the annual Season Pass fee each year and give Season Pass holders notice of the change before or at the start of the next GIG WANL season. 

3.2 Season   
Season Pass shall only apply for the relevant season for which Season Pass fees have been paid.   

3.4 Full Payment Fees and charges   

3.4.1 Prices are GST inclusive.  

4. FURTHER CONDITIONS  

4.1 Conditions  
Conditions of holding a Netball WA GIG WANL Season Pass are as follows:  

  1. The number of games played at the Gold Netball Centre may change each season.  
  2. Netball WA reserves the right to offer additional Season Pass categories, on such Terms and Conditions as it sees fit. Netball WA have the ability to introduce new promotions and offers. Any Season Pass holder who has purchased prior to these offers will not be able to request a refund.  
  3. The GIG WANL Season Pass expires following the completion of the Grand Final for the relevant Gold Industry Group West Australian Netball League season, unless cancelled or surrendered earlier under these Terms & Conditions. Netball WA reserves the right to cancel a Season Pass without refund if the Season Pass holder breaches these Terms and Conditions, or any rules & regulations imposed by the venues on spectators.  
  4. A GIG WANL Season Pass is not inclusive of Finals Matches.  
  5. GIG WANL Season Passes may not, without the prior written consent of the Netball WA, be resold at a premium nor used for advertising, promotion or other commercial purposes (including competitor or trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, then the Season Pass may be cancelled, and the bearer of the ticket may be denied admission.  

5. SEASON PASS CATEGORIES  

5.1 Concession   

Concession Season Pass fees apply to holders of a current Pensioner Concession Card, Veteran Affairs, WA Seniors Card, Companion Card, or a student holding a current full-time Student Card. The Concession rate does not apply to those unemployed.  

Concession identification must be available for presentation when requested upon entry to the venue at matches.  

5.2 Junior  
A Season Pass is not required for juniors under the age of 16 years who are admitted free into GIG WANL Venues. 

Netball WA does not provide, nor is it responsible for, supervision of Junior attendees.     

5.12 Additional Categories  

Netball WA may add new Season Pass categories at any stage and without notice.    

5.13 Removal of Season Pass Categories  

Each season Netball WA performs a Season Pass review and some categories may be removed for the upcoming season. Renewing Season Pass holders will be informed of any categories which are no longer available and provided with an opportunity to purchase a new category.    

5.14 Carer Season Pass  
If a Season Pass holder has special needs, and holds a state issued Companion card, the pass holder is eligible to receive a second Season Pass of the same category at no charge for use by a carer when attending with the paying Season Pass holder.    

6. SEASON PASS CARDS  

6.1 Issue of Season Pass Cards   
A Season Pass card is issued for identification and venue entry.  

6.2 Use of Season Pass cards   
Season Pass cards contain a unique Season Pass number. Cards are to be used as tickets for the GIG WANL Home Match. On entry to the venue, Season Pass cards and (supporting concession identification, where applicable) must be presented upon request.   

6.3 Property of Netball WA   
The Season Pass cards remains the property of Netball WA. Cards may not be sold, exploited for commercial use, or used for promotion purposes or campaigns without the permission of Netball WA.  

6.4 Lost or stolen Season Pass cards (if supplied with a printed card)  

6.4.1 A Season Pass holder must immediately report a lost or stolen card to Netball WA.   

6.4.2 Lost or stolen Season Pass cards will be cancelled upon notifying Netball WA.  

6.4.3 A new Season Pass card will be issued to the Season Pass holder upon payment of the replacement fee of $20.00 and payable to Netball WA at time of request.  

6.4.4 A new Season Pass card will be issued prior to the next home match where possible, alternatively digital tickets or printed tickets will be issued and to be collected at the ticket office at the venue.  

6.5 Misuse of Season Pass cards   
The misuse of a Season Pass card(s), shall result in the Season Pass holders rights being suspended and/or the Season Pass may be cancelled at the discretion of Netball WA.  

6.7 Invitee use/temporary transfer of Season Pass 

6.7.1 Where a Season Pass holder is unable to attend a home match, the Season Pass holder may transfer their card to another person (“Invitee”), provided that the Season Pass being transferred is at an equivalent level to the Invitee. To avoid doubt, concession holders who transfer their Season Pass to an adult will be refused entry and their ticket confiscated at the gate. 

6.7.2 The Season Pass holder acknowledges that their Season Pass may be cancelled or terminated due to a breach of this agreement or misconduct by the Invitee.    

7. VENUE   

7.1 Match Venue   
All dates, times, participating teams and venues of matches will be specified on the official Gold Industry Group West Australian Netball League website,  www.netballwa.com.au/gold-industry-group-wanl and may change from time to time without notice to Season Pass holders.  

7.2 Right to impose additional rules   
The organisation in control of a venue used for a GIG WANL Match, or the state or federal government, has the right to impose on Season Pass holders additional rules and regulations and other operational decisions as may be directed by those organisations from time to time in its discretion (and such rules and regulations may differ between Season Pass conditions of Netball WA).  

7.3 Compliance   
Season Pass holders must comply with the rules and regulations imposed by the organisation in control of the venues, where Home matches are played. If any of these Terms and Conditions or rules and regulations are breached, Netball WA and the venue reserves the right to refuse entry or to remove Season Pass holders from the venues. Please refer to the website of the host venue to view entry their entry Terms and Conditions. Netball WA complies with the Netball Australia Conditions of Entry, which can be viewed at: https://netball.com.au/conditions-entry  

7.4 No liability   
Netball WA shall not be liable to Season Pass holders for any matters arising as a result of the implementation of any such rules and regulations and Season Pass holders must not do anything to cause Netball WA to breach any obligations of Netball WA to any venue or the league.  

8. USE OF SEASON PASS INFORMATION AND CHANGES TO INFORMATION  

8.1 Season Pass Communications   
Season Pass holders who are entitled to receive communication from Netball WA during the Gold Industry Group West Australian Netball League home and away season are required to provide a valid email address when purchasing their Season Pass. All communication made by Netball WA to a Season Pass holder will be carried out in accordance with the Netball Australia Privacy Policy available at https://netball.com.au/privacy-policy  

8.2 Change of information   
Season Pass holders must notify Netball WA, in writing, as soon as possible of any change in circumstance including but not limited to the issuing or withdrawing of concession status; contact details; or other details that could affect the Season Pass held with the Netball WA. Season Pass holders can update their contact information online by emailing info@netballwa.com.au or calling 08 9380 3700.  

9. NO ADDITIONAL RIGHTS  

9.1 Entitlements   
A GIG WANL Season Pass does not entitle the holder to any other right except as expressly set out in the Agreement and the GIG WANL Season Pass.   

10. SEATING  

10.1 General Admission Seating  

All GIG WANL Season Passes are General Admission with seating on a first come first served basis. A Season Pass does not guarantee a reserved seat.   

12. GOLD INDUSTRY GROUP WEST AUSTRALIAN NETBALL LEAGUE FINALS MATCHES  

12.1 Ticketing   

12.1.1 Finals Matches are administered by Netball WA. 

12.1.4 Final ticket access must be purchased during the designated booking period and process as determined by Netball WA.  

13. REFUND POLICY  

13.1 Refund Request   
Any person seeking a refund must do so in writing, addressed to the Netball WA General Manager Community Netball. Refunds will not be issued due to change of mind and will be at the sole discretion of the General Manager and only granted in exceptional circumstances. Should any refund request be approved, the Season Pass holder will need to return their Season Pass card to Netball WA (at their cost) before a refund can be processed. The card must be in a good state of repair (or the cost of repair or replacement may be deducted from the amount of the agreed refund).  

13.2 Use of Season Pass   
A request for refund shall not be considered by Netball WA if the relevant Season Pass holder has utilised their pass for entry to any Home Match prior to making any refund request.  

13.3 Cancellations   
Netball WA is not liable to Season Pass holders for any loss or damage Season Pass holders may suffer as a result of the Gold Industry Group West Australian Netball League Competition or any match being cancelled, postponed or changed and the Season Pass holder acknowledges that any such change or postponement will be at the sole direction of the league or the venue.  

14. BEHAVIOURAL STANDARDS – CODE OF CONDUCT POLICY  

All Season Pass holders must at all times comply with the Netball Australia Conditions of Entry and any additional Venue Terms and Conditions.  
 
Netball WA reserves the right to refuse entry to any person (including Season Pass holders) for any breach of the applicable Conditions of Entry. Season Pass holders who breach these conditions may face penalties, including cancellation without refund. Netball WA reserves all its rights to remove any person, including Season Pass holders or guests from the venue on Match Day for any breach of the Netball Australia Conditions or additional Venue Conditions of Entry.  

15. TERMINATION  

15.1 Breach   
A Season Pass may be terminated by Netball WA for failure to comply with the terms of this Agreement. A Season Pass may also be cancelled due to the misconduct of a Season Pass holder or their invitee. 

16. LIABILITY AND INDEMNITY   

16.1 Responsibility for damage   
A Season Pass holder is responsible for any damage which the Season Pass holder, their guests or any Invitee may cause at any match, function or event of Netball WA if such damage is caused by the Season Ticket holder (or their guest or Invitee’s) willful act or negligence.  

16.2 Limitation of liability   
The maximum aggregate liability Netball WA for all proven losses, damages and claims arising out of this agreement including liability for breach, in negligence or in tort or for any other common law or statutory action, is limited to an aggregate of all claims of the total amount payable under a Season Pass annual payment.  


Where Netball WA’s liability cannot be excluded under any law, Netball WA’s liability will be limited to, at its discretion, either re-supplying the Season Pass to you or paying you the cost of re-supplying the Season Pass to you. Notwithstanding any other clause, Netball WA is not liable to you or to any other person for any losses or damages of any kind caused by or resulting from any wrongful, willful or negligent act or omission by any person or any direct or indirect lost profit or revenue, exemplary damages, deletion or corruption of electronically or digitally stored information, or without limiting the foregoing, any indirect or consequential loss or damage howsoever described or claimed. Each Season Pass holder unconditionally releases Netball WA (and its employees, officers and agents) from any loss or claim which a Season Pass holder might otherwise have against Netball WA or its employees, officers or agents for any:  

  1. injury or loss suffered by any person, regardless of the cause;  

  2. damage or theft to or loss of the Season Pass holder’s property, regardless of the cause; or  

  3. damage or theft to, or loss of, any property, regardless of the cause  

for any reason relating to use of a Season Pass or attendance at any match, event or function run by Netball WA.  

16.3 Indemnity   
You agree to indemnify Netball WA and its employees, officers and agents in respect of all losses, claims and damages that may be brought against Netball WA or its employees, officers or agents as a direct or indirect result of use of the Season Pass or attendance at any match, event or function.  

17. WARRANTIES  

17.1 Netball WA makes no representations or warranties of any kind, express or implied as to the operation of their Season Pass. Each Season Pass Holder expressly agrees that their use of Netball WA Season Pass is entirely at their own risk. However, nothing in this Agreement excludes, restricts or modifies any condition, warranty, right or remedy conferred on a party by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by Agreement.  

17.2 To the fullest extent permitted by law, Netball WA disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose or warranties concerning accuracy, currency or completeness. Netball WA will not be liable for any damages of any kind arising from the use of a Season Pass or attendance at any match, event or functions run by Netball WA.   

18. PRIVACY NOTIFICATION  

Netball WA respects the privacy of the individuals on whom Netball WA collects, uses, discloses and holds personal information. Netball WA complies with the Netball Australia Privacy Policy in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Netball WA uses the personal information it collects at the time of purchase for the limited purpose of processing and administering your Season Pass and providing you with information, materials and promotions relating to Netball WA, its sponsors and Netball Australia, and will be applied in accordance with these Terms & Conditions.  

By purchasing a GIG WANL Season Pass from Netball WA, you agree that your personal information pertaining to your Season Pass may be disclosed to Netball Australia. Subject to the preceding paragraph, you may be contacted by Netball Australia and Netball WA sponsors during the life of your Season Pass in connection with their special offers and other information about their services and products. If you do not wish to receive any such information, please tick the relevant box when purchasing your GIG WANL Season Pass.

19. GENERAL  

19.1 Unless otherwise specified in these Terms and Conditions, A GIG WANL Season Pass does not provide access to additional events or activities for Netball WA, Netball WA and its associated entities.  

19.2 If there is any inconsistency between information in the GIG WANL Season Pass or these Terms & Conditions, then these Terms & Conditions will prevail to the extent of that inconsistency.   

19.3 Failure by Netball WA to enforce any of its rights under this Agreement at any time for any period will not be construed as a waiver of those rights.   

19.4 A GIG WANL Season Pass under this Agreement does not make the holder a member under the constitution of NETBALL WA (INC).  

19.5 Where a provision in the Agreement is deemed to be invalid or unenforceable by a Court of Law in Western Australia, the provision will be deleted from the Agreement, but such deletion will not affect the validity and enforceability of the remaining provisions in the Agreement.   

19.6 Netball WA may send notices and correspondence to your last e-mail address or postal address known to us unless you have notified us of a change of the relevant address before we send the notice or correspondence.  

19.7 Other than as provided elsewhere in this Agreement, we won’t make a change to this Agreement that takes effect during the current Season unless it relates to a matter over which we have little or no control.  

20. GOVERNING LAW  

The Agreement is governed by the law in force in Western Australia.
